The case ,SUIT NO. HOW/309/2021 between Chukwuma Francis Ibezim v. INEC came up today, Wednesday before Justice Chukwuemeka-Chikeka of the High Court of Imo State, for the hearing of the Sir Frank Ibezim’s(Plaintiff) motion for Interlocutory Injunction to restrain INEC from issuing a certificate of return to Senator Ifeanyi Ararume in connection with the bye-election held on 5th December, 2020 for Imo North Senatorial District.
When the case was called up, K.C. Nwufo, SAN informed the court that Senator Ifeanyi Ararume had filed a motion seeking to be joined as a Defendant in the suit.
He also applied to the court to move the motion.
Learned Counsel for the Plaintiff, M. A. Aguda and Idris Yakubu, opposed the application on the ground that they needed time respond to the application for joinder, which was just served on them in open this morning.
The application of the learned Silk to discharge the Interim Injunction was also opposed on the ground that Senator Ifeanyi Ararume had not been joined as a party to the suit, and therefore not in a position to make any application to the court.
The case was thereafter adjourned to 3rd of May 2021 for the hearing of the motion for joinder and the Plaintiff’s motion for Interlocutory Injunction.
